OBJECT AND SCOPE OF APPLICATION

This document establishes the general conditions that regulate access and use of the web platform. https://psychodolltattoo.com/ as well as the hiring of artistic tattoo services and related services offered by Psycho Doll Tattoo Studio.

All users who visit, access, or use the platform's services expressly accept these general terms and conditions, as well as the privacy policy and any other specific terms and conditions that may apply.

Access to and use of the platform is free for the user, without prejudice to the financial cost of contracting the services offered through it.

SERVICES OFFERED

The main services offered by Psycho Doll Tattoo Studio include:

  • Custom artistic tattoos
  • Tattoo consulting and design
  • Touch-up and coverage services
  • Sale of related products
  • Aftercare services

All tattoo services require an appointment and are subject to professional evaluation to ensure technical feasibility and client safety.

CONTRACTING SERVICES

CONTRACTING PROCEDURE

The contracting of services can be done:

  1. In person in the studio located at C/ Marbella 20, Local 89, Palma de Mallorca
  2. By phone by calling 636 814 830

PHASES OF HIRING

  1. Initial consultation and project evaluation
  2. Appointment scheduling
  3. Deposit payment
  4. Custom tattoo design
  5. Design and budget confirmation
  6. Performance of the service

CONDITIONS FOR THE PROVISION OF THE SERVICE

For tattoos to be performed, the following is an essential requirement:

  • Be older than 18 years or have written parental authorization if you are a minor (according to current legislation)
  • Present valid identification document
  • Not be under the influence of alcohol or narcotics
  • Do not present medical contraindications that advise against getting a tattoo
  • Sign the informed consent correspondent

DEPOSIT AND RESERVATION POLICY

DEPOSIT FOR APPOINTMENT RESERVATION

To secure any tattoo service, a deposit is required, representing a percentage of the total service quote.

DEPOSIT CONDITIONS

  • Accepted payment methods: Cash at the tattoo studio, bank transfer, PayPal or Bizum
  • IMPORTANT: THE DEPOSIT IS NON-REFUNDABLE UNDER ANY CIRCUMSTANCES once payment has been made
  • Purpose of the deposit: The deposit covers personalized consultation services, exclusive design and technical preparation of the project.
  • Immediate start of services: Once the deposit has been paid, the personalized consultation and exclusive tattoo design process begins immediately, and a few hours and days are scheduled for the client.
  • Services included in the deposit:
    • Personalized consultation and project evaluation
    • Creation of exclusive artistic design
    • Adaptation of the design to the client's specifications
    • Technical preparation and session planning
  • NON-REFUNDABLE: The deposit is retained in all cases (cancellation, rescheduling, no-show or any other circumstance)
  • Application to the final service: The deposit is deducted from the total amount at the time of tattooing.
  • Express acceptance: By paying the deposit, the client expressly accepts the immediate start of these personalized services and the non-refund policy.

CANCELLATION POLICY

Cancellation by the customer:

  • More than 48 hours in advance: Possibility of rescheduling the appointment. THE DEPOSIT IS NON-REFUNDABLE IN ANY CASE
  • With less than 48 hours' notice: THE DEPOSIT IS NON-REFUNDABLE design and consultation services having already been provided
  • No show for appointment: TOTAL LOSS OF DEPOSIT WITHOUT POSSIBILITY OF RETURN

IMPORTANT: The deposit is never refundable, regardless of the reason for cancellation (medical emergency, change of mind, personal circumstances, etc.). We do accept rescheduling.

Cancellation by the studio:

  • In case of cancellation due to reasons attributable to the studio, the full deposit will be refunded or the appointment will be rescheduled according to the client's preference.

RIGHT OF WITHDRAWAL

Pursuant to Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users, the customer has the right to withdraw from the contract within 14 calendar days of the date of the contract.

LIMITATIONS ON THE RIGHT OF WITHDRAWAL

According to article 103 of the aforementioned Royal Decree, the right of withdrawal will NOT be applicable In the following cases:

  • Services fully executed: When the consultation and personalized design services have been fully provided with the express consent of the consumer
  • Goods made to specifications: Tattoo designs are custom artistic creations made to the client's specifications.

PRACTICAL CONSEQUENCE: Once the deposit has been paid and the consultation and personalized design services have begun, THE DEPOSIT IS NOT REFUNDABLE under any circumstances, including the exercise of the right of withdrawal.

EXERCISE OF THE RIGHT OF WITHDRAWAL

To exercise the right of withdrawal (where applicable), the customer must notify us in writing to:

Returns: If withdrawal is appropriate, the amount will be refunded within a maximum of 14 calendar days using the same payment method used or by bank transfer. This does not apply to appointment deposits.

ECONOMIC CONDITIONS

RATES AND BUDGETS

  • Prices are set based on the complexity, size and estimated time for each project.
  • All quotes include VAT and are valid for 30 days from the date of issue.
  • The prices published on the website are indicative only; the final quote will be established after a personalized consultation.

PAYMENT METHODS

Deposits:

  • Cash, bank transfer, PayPal, Bizum

Final payment of the service:

  • Cash, credit/debit card, bank transfer

BILLING

All services provided will be duly invoiced with the corresponding VAT. The invoice will be issued at the time of service or via electronic invoicing upon request.

CUSTOMER OBLIGATIONS

The client agrees to:

  • Provide truthful information about your health status and relevant medical conditions
  • Follow aftercare instructions provided by the professional
  • Arrive on time to scheduled appointments
  • Maintain proper hygiene the day of the tattoo
  • Do not consume alcohol or drugs before the session
  • Respect the rules of behavior in the study
  • Pay the amounts within the agreed timeframes and forms

STUDY OBLIGATIONS

Psycho Doll Tattoo Studio is committed to:

  • Use sterile, single-use material in accordance with current health regulations
  • Maintain maximum hygiene conditions on the premises
  • Provide complete information on tattoo aftercare
  • Get the job done with the utmost professionalism and artistic quality
  • Comply with all regulations applicable health and legal
  • Maintain confidentiality of customer data

WARRANTIES AND LIMITATIONS OF LIABILITY

SERVICE GUARANTEES

  • Artistic quality: We guarantee the technical and artistic quality of the work carried out
  • Sanitary conditions: Strict compliance with all applicable health regulations
  • Touch-ups: We offer a free touch-up session within 30 days if necessary due to defects attributable to the technique.

LIMITATIONS OF LIABILITY

The studio is not responsible for:

  • Allergic reactions to the inks used (a prior allergy test is recommended)
  • Abnormal healing processes caused by the client's pre-existing medical conditions
  • Infections arising from failure to follow aftercare instructions
  • Aesthetic results when the client has not followed professional recommendations
  • Design modifications requested by the client during execution

PERSONAL DATA PROTECTION

The processing of personal data is governed by our Privacy Policy, which the customer must expressly accept. Data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on Personal Data Protection.

Purposes of treatment:

  • Provision of contracted services
  • Appointment and communication management
  • Compliance with legal obligations
  • Sending commercial information (with consent)

INTELLECTUAL PROPERTY

DESIGN RIGHTS

Tattoo designs made by Psycho Doll Tattoo Studio designs are original artistic creations protected by copyright. The client acquires the right to personal use of the design, but not commercial exploitation.

REPRODUCTION AND DISSEMINATION

The studio reserves the right to photograph completed work for its professional portfolio and social media promotion, unless expressly objected to by the client.

DURATION AND TERMINATION OF THE CONTRACT

DURATION

The contract is finalized upon acceptance of the estimate and payment of the deposit, and remains in effect until the contracted service is fully executed.

CAUSES OF EXTINCTION

The contract will be terminated by:

  • Compliance of the contracted service
  • Mutual agreement of the parts
  • serious breach of the obligations of either party
  • Supervening impossibility of service provision

CONFLICT RESOLUTION

MEDIATION AND ARBITRATION

For the resolution of disputes, the parties expressly submit to the consumer mediation and arbitration systems established by current legislation.

APPLICABLE JURISDICTION

In the absence of an out-of-court ruling, the jurisdiction of Palma de Mallorca will be competent, and Spanish law will apply.

GENERAL DISPOSITION

MODIFICATIONS

Psycho Doll Tattoo Studio reserves the right to modify these terms and conditions, providing notice of changes through the website at least 30 days in advance.

VALIDITY

If any clause of these terms and conditions is declared null and void, the remainder of the document shall remain in full force and effect.
